To form a Nevada LLC, you must file Articles of Organization, submit an operating agreement (strongly recommended even if it’s not required), appoint a registered agent, and obtain a state business license. 

Montana LLCs have a similar process but don’t require a business license at the state level. Only the Articles of Organization and the appointment of a registered agent are strictly required. However, many LLCs still need local or industry-specific licenses or permits to operate legally, which can be a hassle later.

Nevada, in contrast, has higher costs. The initial filing fee, including the Articles of Organization, is $75. You must also pay $150 for the state business license and $200 for the initial list of managers or members, bringing total formation costs to $425. Annually, you’ll need to renew the business license and file the annual list, totaling $350 per year. 

While the fees are steeper, many businesses see this as a fair trade-off for Nevada’s strong asset protection laws and a highly advantageous business climate.

In Nevada, business owners benefit from more privacy and anonymity. The state does not require listing the names of members or managers in the Articles of Organization.
