Start Your Business with a Nevada LLC

The ONLY 5-Star Rated Business Formation Company Excellent

It’s inevitable, if you’re in the military, you’ll be moving to a new state at some point. Of course, you change your address, update utilities, etc. But what about the LLC you set up? There are a lot of variables you’ll need to consider. The Registered Agent is the main thing we need to stay on top of. The Registered Agent is the legal address on record that receives notice in the event of a lawsuit and is also the address the Secretary of State sends your renewal notices to. Thankfully, NCH has offices in all 50 states to serve as your Registered Agent when needed. I’ll give you a rundown of my thought process and determining your best course of action.

If you’re an “Active Income Business,” meaning your company generates self-employed income for selling products or services, you’ll most likely want to keep the LLC open and simply register your LLC with the state you’re moving to. This allows you to keep the same Employer Identification Number (EIN), same checking account, same credit accounts, etc. The processing of registering your LLC with your new state is called foreign filing. Keep in mind, if you were serving as your own Registered Agent, you’ll want to hire a registered agent service. (Call NCH).

If you’re a “Passive Income Business,” meaning you’re holding rental properties, we’ll want to be sure to register the LLC appropriately with state where the properties are located. There is no legal requirement to register with the new state you’re moving to, unless you move California! If for example you live in North Carolina and you set up a North Carolina LLC to own a rental property in North Carolina, and listed yourself as the Registered Agent, you’re going to need to hire a registered agent when you move.

If you’ve followed my guidance and have established your LLC in Wyoming and have NCH as your registered agent, you just need to call our office, and we take care of the rest.
