It’s inevitable, if you’re in the military, you’ll be moving to a new state at some point. Of course, you change your address, update utilities, etc. But what about the LLC you set up? There are a lot of variables you’ll need to consider. The Registered Agent is the main thing we need to stay on top of. The Registered Agent is the legal address on record that receives notice in the event of a lawsuit and is also the address the Secretary of State sends your renewal notices to. If you’re an “Active Income Business,” meaning your company generates self-employed income for selling products or services, you’ll most likely want to keep the LLC open and simply register your LLC with the state you’re moving to. This allows you to keep the same Employer Identification Number (EIN), same checking account, same credit accounts, etc. The processing of registering your LLC with your new state is called foreign filing. Keep in mind, if you were serving as your own Registered Agent, you’ll want to hire a registered agent service. If you’re a “Passive Income Business,” meaning you’re holding rental properties, we’ll want to be sure to register the LLC appropriately with state where the properties are located. There is no legal requirement to register with the new state you’re moving to, unless you move California! If for example you live in North Carolina and you set up a North Carolina LLC to own a rental property in North Carolina, and listed yourself as the Registered Agent, you’re going to need to hire a registered agent when you move.
