What Are DAPTs?

When Nevada DAPTs are created, the following conditions apply:

  • A creditor seeking to block a transfer to a NAPT must challenge it within:
    • Two years after the transfer
    • Six months after the creditor discovered or should have discovered the transfer.
  • If a child or spousal support order is enforced on a NAPT’s settlor, an exception creditor can obtain the assets in the trust after the statute of limitations ends. However, Nevada doesn’t recognize these creditors.
