Montana's LLC laws offer charging order protection, making it challenging for creditors to access a member's assets directly. However, the state's extensive legal history and specialized courts may provide a more robust form of asset protection.
Formation Requirements and Maintenance
Delaware imposes relatively low barriers to entry, allowing for simple and convenient LLC formation. In addition, members are not required to reside in Delaware, and the state has efficient online filing systems.
Although Montana has a more affordable annual report fee compared to Delaware's franchise tax, the state requires more public disclosure, with LLC members' names and addresses being publicly available information. This can be appealing for businesses on a budget.
